Goodman 12-6-09 Sent  After reporting for years the undisputed corruption of the Pottsville District Mining Office, Mr. Goodman did nothing to stop the destruction of evidence that would prove undocumented blasting in front of my home.  He failed to contact the judge on our behalf even though they both worked in the same courthouse.

DEP 12-6-09 Sent  Informing Thomas Callaghan won a court order that fined my family $3,434.75 during the Christmas holiday.  This judgment was due entirely to the corruption and refusal of his department to step forward with the truth.

Aichele 12-4-09 Sent  Letter asking Adam D. Aichele of the F.B.I. why he failed to intervene on our behalf and allow the judge to rule in favor of the MBSA.  This decision allows the MBSA the authority to destroy evidence of undocumented blasting and sell our home for the privilege.  Is there any sanity left in this state or is it just one big corrupt free for all?

Obama 12-4-09 Sent  Letter written to President Barak Obama asking his office to intervene and get my government officials to contact me; never expected a reply but I am out of options.

DEP 11-29-09 Cover Letter Sent  This is just another letter similar to ones that have been sent for years asking why this has been allowed to continue while my family suffers

Hanger 11-21-09 Sent Informing PA DEP Secretary John Hanger that Thomas Callaghan, District Mining Manager sent signed affidavit that stated DEP lied to my family for over six years and never had the raw blast roll in the possession; asked if disciplinary action will be taken and if he still considers my blasting damage “thoroughly investigated”.

Hanger Enclosure 11-21-09 Sent  This was enclosure sent to John Hanger  This was an interoffice memo that was inadvertently sent with one of my replies form Thomas Callaghan’s office referring to my family’s suffering as “the saga continues”  or a joke.

Mutchler 11-19-09 Letter Sent  Notifying Terry Mutchler that has violated his own RTKLR regulations and I still do not have the hard copies requested.  As I am writing this intro on 1/9/10 they just came in the mail; part 1 still waiting on part 2   

Prothonotary 10-21-09 Sent  Under Sch.R.C.P.206.7(d) I am requesting that the following “brief” of our “respective position” be considered before this honorable court renders a final decision.

Prothonotary 10-14-09 Sent  Informing the Schuylkill County Prothonotary that Richard P. Mislitsky ordered my family never to contact him.

DEP 10-3-09 Sent  A letter sent to Thomas Callaghan asking why his department chose to ignore the corruption and allow my family to suffer for years.  This letters is similar to past letters submitted to Tom; those were also ignored.

Mutchler 8-2-09 Letter Sent  Explaining to the Office of Open Records that I feel the Final Determination filed by Audrey Buglione to be biased in favor of the PA DEP.  I feel that warning me to abandoned future attempts to obtain records because it would be construed as Repetitive and Disruptive” a violation of my civil rights.

Mutchler 6-7-09 Letter Sent 007  It was later ruled by the Office of Open Records that the PA DEP can refuse to send documents of testimony taken during an investigation even if they are using the RTKL to conspire to obstruct justice.

Mutchler 5-23-09 Letter Sent  Letter sent to Mr. Mutchler thanking him for his help with the DEP corruption; little did I realize that the corruption spread from DEP to the Office of Open Records like a virus.

FBI 5-21-09 Sent Email  A complaint sent to the FBI over the way they handled our complaint.  I don’t care if they are the FBI my family was entitled to a simple yes or no; were not the criminals we are the victims.  Whatever happened to our rights?

Thomas Callaghan Affidavit Raw Blast Roll 5-20-09  After six years of countless lies from one DEP government official after another Thomas Callaghan admits that the PA DEP never had the raw blast roll.  DEP lied to my family for over six years and never investigated my blast records as claimed. DEP does not have a clue if these are our blast records, for all they know these could be blast records from some farm down in Lancaster County.  What was the response from the PA DEP over our outrage?  Complete silence and more corruption.  

DEP 5-4-09 Sent  Letter asking DEP for documents to prove that they contacted my family or any family in McAdoo notifying them to properly check for home damage.

RTKL 4-29-09 DEP Letter Sent  All the effort and investigations conducted by the PA DEP into my allegations of undocumented blasting and not one soil sample was taken; how corrupt can one government agency be?

RTKL 4-26-09 DEP Letter Sent  Another letter sent to DEP asking why they continue to violate my RTKLR despite the new law implemented by President Barak Obama.

RTKL 4-23-09 DEP Letter Sent  Requesting any documents to prove that the PA DEP conducted a “thorough investigation” as claimed.  All documents were denied; sounds like conspiracy to obstruct justice since the requests was denied not to protect the integrity of the investigation but the illegal activity conspired during the investigation.

RTKL 4-21-09 DEP Letter Sent  Requesting documents from the PA DEP that led their investigators to decide that there was no undocumented blasting done to my home despite several eyewitnesses and my home video showing fuse being dug from the ground and no blast records.

RTKL 4-20-09 DEP Letter Sent  Letter letting the PA DEP know that they have violated my RTKLR; it obviously takes time to think up lies.

RTKL 4-20-09 McAdoo Letter Sent  McAdoo Borough wanted to charge me $14.50 for my RTKLR; had to redefine my request.  All that I received were copies of documents that I sent to them and nothing the sent in reply; typical.

RTKL 4-14-09 Letter Sent  This was a letter sent to McAdoo Borough for documents where the borough notified their residents to properly look for property damage.  I complained about his for years, no one including the PA DEP tried to help these residents even though DEP admitted that this was the worst case of blasting violations ever recorded in the state.  

RTKL 4-12-09 no3 Letter Sent  Bill Mingo was another neighbor that lived on the opposite corner and witnessed the violent blasting done to my home.  This was brought to the attention of the DEP investigators several times and they promised to take his testimony.  Mr. Mingo was also a witness for DEP in court.  Mr. Mingo told me that investigators from DEP advised him not to mention what he witnessed in court relating to my home; last I checked that is a felony.  

RTKL 4-12-09 no2 Letter Sent  Rod Sergent was the engineer in charge of the McAdoo Borough Sewer Authority sewer installation from Spotts, Stevens and McCoy, Inc.  Rod was an eyewitness to the violent blasting done to my home on January 31, 2003.  Rod remained silent for months despite constant contact with the PA DEP and my family.  We brought this to the attention of the PA DEP but they refused to disclose the interview from their “thorough investigation” with Mr. Sergent.  This is another one of those documents that the PA DEP refused to disclose for years; more conspiracy to obstruct justice. 

RTKL 4-12-09 Letter Sent  Charles Sube was an eyewitness to the violent blasting done to my home.  Charlie was retired and lived across the street and described my blasting “as if a bomb was dropped on our home”.  We brought this to the attention of the DEP investigators several times and each time we were promised that they would take his testimony.  DEP refuses to disclose this testimony citing the need to protect my deceased neighbor’s reputation despite years of RTKLR.

RTKL 4-10-09 no5 Letter Sent  I have been asking for this raw blast roll document for over 6 years.  This was the raw blast roll from the seismograph that was used for the blasting records that the PA DEP attached to my home.  After six years of conspiring to obstruct justice the PA DEP just admitted that they never had these documents in their possession.

RTKL 4-10-09 no4 Letter Sent  I accidentally discovered that I had video proof of undocumented blasting next to my home; DEP refused to look at the video.  I then retrieved individual photos from the video and spoon fed the evidence in the form of a Power Point Presentation to the PA DEP; the presentation disappeared.  This is another of my attempts under the RTKL to force the PA DEP that they had the document and suppressed the evidence.

RTKL 4-10-09 no3 Letter Sent  This is another RTKLR asking for the document from Darrell Zavislak. Mr. Zavislak conducted an official investigation on behalf of the PA DEP into undocumented blasting.  I believe that the PA DEP suppressed his document because it stated that there probably was undocumented blasting.  DEP has refused to turn over this document for years.

Corbett 2-2-09 Sent Attorney General Tom Corbett sent me a letter informing me that DEP crushing my Right-to-Know Law rights are not under his jurisdiction; this is my reply
